Preamble: This Liber establishes the framework for continuous, automated regulatory compliance and data privacy within the PTVS ecosystem. It ensures that tokenized Real-World Assets (RWAs) maintain strict adherence to Anti-Money Laundering (AML), Know Your Customer (KYC), and data protection regulations throughout the entire asset lifecycle, resolving the inherent tension between regulatory transparency and user privacy.
Dynamic Identity Verification & Eligibility (Continuous AML/KYC)
The issuance and transfer smart contracts (e.g., PTVSClaimInjector.sol and associated ERC-3643 identity registries) shall integrate with Decentralized Identity (DID) systems and Verifiable Credentials fully compliant with the eIDAS 2.0 Regulation (EU) No 910/2014 (as amended).
Every secondary market transaction shall require real-time, cryptographic validation confirming that the recipient investor maintains active “Qualified Investor” status and complies with global Anti-Money Laundering/Combating the Financing of Terrorism (AML/CFT) watchlists. This shall be executed utilizing Zero-Knowledge Proofs (ZKP) or similar privacy-preserving technologies, ensuring no personal data is stored in plaintext on the ledger, in strict adherence to the General Data Protection Regulation (GDPR), particularly Article 25 (Data Protection by Design and by Default).
Automated Forensic Freeze for Subsequent Non-Compliance
Should an investor lose their regulatory authorization, be added to international sanctions lists (e.g., OFAC, EU Consolidated List), or violate the FATF Travel Rule, the protocol shall autonomously and immediately activate a Forensic Freeze on the digital assets associated with their sovereign identity.
This legal and technical action shall isolate the non-compliant digital asset without compromising the liquidity, fungibility, or operational integrity of the broader tokenized fund, thereby protecting the issuer and platform operators from secondary regulatory liability.
Data Minimization and Right to Erasure Compatibility
All off-chain identity and compliance data must be stored in secure, GDPR-compliant environments with strict access controls. On-chain records shall exclusively contain cryptographic hashes, non-reversible identifiers, and compliance status booleans.
The architecture natively supports the GDPR “Right to be Forgotten” (Article 17) by allowing the authorized revocation of off-chain credential links. Upon revocation, the corresponding on-chain hash becomes cryptographically orphaned and meaningless, effectively achieving data erasure without requiring the immutable alteration of the distributed ledger.
