1. El punto ciego judicial. Los tribunales de todo el mundo admiten rutinariamente documentos en papel de origen dudoso mientras rechazan registros forenses anclados en blockchain calificándolos de «opacos» o «técnicamente inescrutables». Esta inversión de la lógica probatoria genera inseguridad jurídica para los Activos del Mundo Real (RWA) tokenizados: un inversor puede poseer un registro forense inmutable y criptográficamente sellado del estado físico de un activo, y aun así verlo descartado por un tribunal no familiarizado con la tecnología de registro distribuido.
2. Objeto del presente Estándar. El JEAS v1.0 establece una regla procesal uniforme: todo registro forense que satisfaga una cadena de custodia criptográfica definida será auto-autenticable, gozará de una presunción refutable (iuris tantum) de integridad y veracidad, y será valorado por tribunales y tribunales arbitrales bajo las reglas de la sana crítica con una base de fiabilidad jurídicamente definida. Asimismo, reconoce al Perito de Sistema Certificado (PTCE) un estatus procesal propio y una inmunidad cualificada, alineando la práctica forense digital con las protecciones tradicionales del perito designado por el tribunal.
1. The judicial blind spot. Courts worldwide routinely admit paper documents of dubious origin while rejecting blockchain-anchored forensic records as «opaque» or «technically inscrutable». This inversion of evidentiary logic creates legal uncertainty for tokenized Real-World Assets (RWAs): an investor may hold an immutable, cryptographically sealed forensic record of an asset’s physical state, yet find it disregarded by a tribunal unfamiliar with distributed ledger technology.
2. The purpose of this Standard. The JEAS v1.0 establishes a uniform procedural rule: a forensic record that satisfies a defined cryptographic chain of custody shall be self-authenticating, shall enjoy a rebuttable presumption (iuris tantum) of integrity and veracity, and shall be assessed by courts and arbitral tribunals under the rules of sound criticism with a legally defined reliability baseline. It further grants the Certified System Expert (PTCE) a defined procedural status and qualified immunity, aligning digital forensic practice with the traditional protections of court-appointed experts.

- «Registro Cualificado de Evidencia Forense (QFER)»: un registro de auditoría forense que comprende (i) un esquema legible por máquina (PTVS-WHR.json), (ii) una renderización PDF/A-3 (ISO 19005-3) con ficheros probatorios originales embebidos, (iii) una Firma Electrónica Cualificada (QES) o Sello Electrónico Cualificado bajo eIDAS 2.0, (iv) un Sello de Tiempo Cualificado (RFC 3161 / eIDAS Art. 42), y (v) un anclaje criptográfico de su hash en un registro distribuido. “Qualified Forensic Evidence Record (QFER)” means a forensic audit record comprising (i) a machine-readable schema (PTVS-WHR.json), (ii) a PDF/A-3 (ISO 19005-3) rendering with embedded original evidentiary files, (iii) a Qualified Electronic Signature (QES) or Qualified Electronic Seal under eIDAS 2.0, (iv) a Qualified Time Stamp (RFC 3161 / eIDAS Art. 42), and (v) a cryptographic anchor of its hash on a distributed ledger.
- «Anclaje Criptográfico»: el registro del hash del informe (SHA-256 o Keccak-256) en un registro inmutable dentro de las 72 horas posteriores a su firma, permitiendo a cualquier tercero verificar la integridad post-firma. “Cryptographic Anchoring” means the registration of the record’s hash (SHA-256 or Keccak-256) on an immutable ledger within 72 hours of signature, enabling any third party to verify post-signature integrity.
- «Perito de Sistema Certificado (PTCE)»: un profesional forense acreditado bajo una metodología abierta y publicada (PTVS Global Academy), titular de una credencial QES vigente y de un seguro de responsabilidad civil profesional. “Certified System Expert (PTCE)” means a forensic professional accredited under an open, published methodology (PTVS Global Academy), holding a valid QES credential and professional civil liability insurance.
- «Cadena de Custodia Digital»: la identificación, recolección, adquisición y preservación de evidencia digital conforme a ISO/IEC 27037:2012. “Digital Chain of Custody” means the identification, collection, acquisition and preservation of digital evidence in accordance with ISO/IEC 27037:2012.
Capítulo II — Admisibilidad y Presunción de IntegridadChapter II — Admissibility & Presumption of Integrity
Artículo 2 · Auto-autenticaciónArticle 2 · Self-Authentication
Un QFER será admitido como prueba sin necesidad de fundamento adicional ni testimonio de patrocinio. Satisface el requisito de autenticación aplicable a los registros electrónicos generados por proceso (cf. US FRE 902(13)–(14); eIDAS Arts. 35–46 sobre sellos y sellos de tiempo electrónicos), mediante la producción de la ruta de verificación: hash original, hash firmado, token de sello de tiempo y anclaje en registro distribuido. A QFER shall be admitted in evidence without further foundation or sponsoring testimony. It satisfies the authentication requirement applicable to process-generated electronic records (cf. US FRE 902(13)–(14); eIDAS Arts. 35–46 on electronic seals and timestamps), upon production of the verification path: original hash, signed hash, timestamp token, and ledger anchor.

- Un QFER se presumirá exacto, completo e inalterado desde el momento de su sello de tiempo cualificado. A QFER shall be presumed accurate, complete and unaltered since the moment of its qualified timestamp.
- La presunción podrá ser refutada únicamente mediante prueba clara y convincente de un vector de ataque específico: (i) compromiso de la clave cualificada del firmante; (ii) ruptura de la cadena de custodia ISO/IEC 27037; o (iii) colisión de hash o reorganización del registro distribuido que afecte al anclaje. Las alegaciones genéricas de «opacidad técnica» no bastarán. The presumption may be rebutted only by clear and convincing evidence of a specific attack vector: (i) compromise of the signatory’s qualified key; (ii) break in the ISO/IEC 27037 chain of custody; or (iii) demonstrated hash collision or ledger reorganization affecting the anchor. General allegations of «technical opacity» shall not suffice.

- Los tribunales valorarán los QFER conforme a las reglas de la sana crítica (cf. Art. 335.2 LEC; CPR 35; equivalentes de la Ley Modelo UNCITRAL Art. 5). Tribunals shall assess QFERs under the rules of sound criticism (cf. Art. 335.2 LEC; CPR 35; UNCITRAL Model Law Art. 5 equivalents).
- Para dicha valoración, un QFER que satisfaga el Artículo 1 se considerará que cumple el umbral de fiabilidad técnica; un mero documento electrónico carente de firma cualificada, sello de tiempo o anclaje («Informe Tipo A») no gozará de presunción alguna y requerirá prueba fundacional completa. For such assessment, a QFER satisfying Article 1 shall be deemed to meet the threshold of technical reliability; a mere electronic document lacking qualified signature, timestamp or anchoring («Type-A Report») shall enjoy no presumption whatsoever and shall require full foundational proof.

Capítulo IV — El Perito de Sistema Certificado (PTCE)Chapter IV — The Certified System Expert (PTCE)
Artículo 5 · Estatuto ProcesalArticle 5 · Procedural Status
Un PTCE que testifique o emita dictamen bajo una metodología abierta y publicada será reconocido como Perito de Sistema Certificado, categoría funcionalmente equivalente al perito designado por el tribunal (perito de sistema), con independencia de cuál de las partes lo haya contratado. A PTCE testifying or reporting under an open published methodology shall be recognized as a Certified System Expert, a category functionally equivalent to the court-appointed expert, irrespective of which party retained them.
Artículo 6 · Inmunidad Procesal CualificadaArticle 6 · Qualified Procedural Immunity
El PTCE no incurrirá en responsabilidad civil por las opiniones emitidas de buena fe conforme a la metodología publicada, salvo en casos de fraude, dolo o negligencia grave. Esta inmunidad refleja la tradicionalmente reconocida a los peritos designados por el tribunal y queda condicionada a: (i) credencial QES válida; (ii) seguro de responsabilidad civil profesional activo; (iii) revelación completa de la ruta de verificación. A PTCE shall not incur civil liability for opinions rendered in good faith in conformity with the published methodology, save in cases of fraud, wilful misconduct or gross negligence. This immunity mirrors that traditionally afforded to court-appointed experts and is conditioned upon: (i) valid QES credential; (ii) active professional liability insurance; (iii) full disclosure of the verification path.

- El derecho de confrontación de la parte contraria quedará satisfecho mediante la entrega de la ruta de verificación y el acceso razonable al perito. The opposing party’s right of confrontation shall be satisfied by delivery of the verification path and reasonable access to the expert.
- No podrá compelirse la revelación de datos personales más allá de lo estrictamente exigido por eIDAS 2.0 y el RGPD; el valor probatorio del QFER no dependerá de la revelación de los datos personales subyacentes. No disclosure of personal data beyond what eIDAS 2.0 and GDPR strictly require shall be compelled; the QFER’s evidentiary value shall not depend on disclosure of underlying personal data.
Capítulo V — Reconocimiento Transfronterizo y ArbitrajeChapter V — Cross-Border Recognition & Arbitration
Artículo 8 · Reconocimiento MutuoArticle 8 · Mutual Recognition
Un QFER emitido lícitamente en una jurisdicción no podrá ser privado de eficacia probatoria en otra por el mero hecho de su forma electrónica o de su anclaje en registro distribuido (principio de reconocimiento mutuo de eIDAS; Ley Modelo UNCITRAL sobre Comercio Electrónico, Arts. 5–6). A QFER lawfully issued in one jurisdiction shall not be denied evidentiary effect in another on the sole ground of its electronic or ledger-anchored form (principle of eIDAS mutual recognition; UNCITRAL Model Law on Electronic Communications, Art. 5–6).
Artículo 9 · Procedimientos ArbitralesArticle 9 · Arbitral Proceedings
Los tribunales arbitrales con sede bajo la Convención de Nueva York (1958) aplicarán los Artículos 2 a 4 mutatis mutandis. Un laudo fundado en un QFER no podrá ser impugnado por el mero motivo de que la prueba fuera «electrónica» o «anclada en registro distribuido». Arbitral tribunals seated under the New York Convention (1958) shall apply Articles 2–4 mutatis mutandis. An award resting upon a QFER shall not be challengeable on the ground that the evidence was «electronic» or «ledger-anchored».
Anexo I — Requisitos Técnicos Completos del QFERAnnex I — Full Technical Requirements of the QFER
El Anexo I desarrolla los 8 requisitos enumerados en el Capítulo III y especifica los parámetros técnicos mínimos, los algoritmos aceptados y los mecanismos de verificación pública. Los tribunales podrán remitirse a este Anexo para resolver cuestiones de admisibilidad técnica sin necesidad de peritaje de parte. Annex I develops the 8 requirements listed in Chapter III and specifies the minimum technical parameters, accepted algorithms and public verification mechanisms. Courts may refer to this Annex to resolve technical admissibility issues without the need for party-appointed expert evidence.
